An Online Seller Faces Charges From An Online Buyer

Buying and selling elevated to a different level, from its medieval concept of physical barter to modern-day digital selling. It is probably one of this generation's biggest disruption and the only thing that didn't change is the product and the money but everything else all went digital. Though almost everything is fast and digital, it is always best to be cautious in everything we do. Though experience is the best teacher, it shouldn't be always that way.

Recently, Ms. Maricar Banaag, an online buyer on Facebook, filed an estafa case at the Paranaque Prosecutors Office against Ms. Daisy Borja, an online seller who according to Ms. Banaag owns different online businesses and conducts her transactions through different online pages like "Ninang Daisy's Online Shop" and "Miracle Jewels Online Shoppe".

According to Ms. Banaag, it was October when Ms. Daisy Borja conducted a live video on Facebook offering a 1.25-carat diamond ring. "On the basis of Ms. Borja's representations and promises, I made a bid for the diamond ring and won as the highest bidder." as stated in Ms. Banaag's complaint-affidavit.

She also added that she paid for it via a check Php 405,295 which includes the Php 160,000 for the diamond ring. The check was cleared on October 18 and got it the day after.

When Ms. Banaag had the ring check with her setter it turns out that the 1.25 carats in weight were only 0.71 carats.

According to her, when she sought Borja's attention she was expecting her to be agreeable to talk, apologetic and consider a refund but instead, she was met with profanity. She adds "I was then blocked on Facebook, she also ignored my calls and text messages. The manner of Ms. Borja's actuations prevented me from returning the ring to her and get a full refund." as stated on her affidavit.

Ms. Daisy Borja is currently facing charges of Estafa and violation of Article 50 and 64 of the Republic Act 7364 (Consumer Protection Act of the Philippines) which prohibits sale through deception.
